Internal investigations in the workplace: everything you need to know and avoid


In the workplace, sensitive and sometimes serious situations can arise, such as internal theft, harassment, inappropriate behaviour or incidents relating to data confidentiality. These events are delicate to deal with and raise crucial issues for the employer, who has a responsibility to protect the integrity of the company, and for employees, who are entitled to a working environment that is fair and respects their rights. 

In this context, internal investigations carried out in the workplace have become common practice: employees are audited, reviewed, observed, searched and questioned and, where necessary, specialists are commissioned to carry out investigations. But what about the regulations applicable to these private investigation activities, which are carried out without the use of police officers, at least initially? What can and cannot be done? What are the findings worth?

PROGRAMME

The goal of this seminar will be to present the process of an internal investigation, from its beginning to its conclusion, as well as the subsequent use of the findings from a legal and practical perspective. In particular, we will attempt to answer the following questions:   

  • When should an internal investigation be launched following a report or other facts that prompted the investigation?
  • How should the investigation team be put together?
  • What investigation methods are available?
  • Is it possible to use external investigation companies and what is the impact of the (future) law on private investigation?
  • How can an internal investigation be combined with the tasks entrusted to prevention advisors, including psychosocial aspects?
  • How do you interview workers as witnesses or suspects and draw up an investigation report?
  • How can the use and probative value of internal investigation procedures be guaranteed?
