Union negotiation workshop

Negotiation is omnipresent in the workplace, whether with other departments, professions or trade unions. It is based on rules and principles that you need to know in order to establish a fair position while remaining open to the reality of the other party, thereby promoting effective consultation.
OBJECTIVES
1. Social negotiation mainly involves:
- Carrying out the various stages of negotiation with the social partners, from preparation to the conclusion of an agreement;
- Mastering communication techniques in a social negotiation context;
- Identifying the causes of blockages and anticipating conflicts;
- Conducting negotiations successfully and emerging from conflicts;
- Assessing the place that you give to the trade unions and the place that the trade unions take.
2. Understanding social negotiation involves several phases:
- Better self-awareness in relation to the existence of a counter-power;
- Increased knowledge of the trade union partner, both inside and outside the company;
- Perfect preparation thanks to a very detailed analysis of the personal and institutional issues at stake in the company's social bodies;
- Knowledge of the legal and regulatory framework;
- A good command of negotiation techniques, specifically the mastery of ways of coming together and the use of reciprocal concessions (WIN-WIN situations).
METHODOLOGY
Interactive teaching using practical negotiation scenarios that can be adapted to the participants' professional environment. During the exercises, participants can act alternately as employer or union representatives. After all, you learn a lot by putting yourself in "the other's" shoes.
To ensure the active participation of all participants, numbers are limited to a maximum of 15.

Introductory presentations and interactive discussions:
- The basic principles relating to knowledge of social partners (organisations and players);
- The rules of good social governance;
- The principles and rules of negotiation;
- Malfunctions (union excesses, intentional misrepresentation, drafting of reports);
- Listening to situations experienced by participants.
Case studies based on:
- · Une problématique liée au fonctionnement des représentants du personnel au sein des organes sociaux, notamment le temps consacré aux missions syndicales.
PROGRAMME FOR TUESDAY 2 SEPTEMBER
Debriefing of the 1st day of training;
Case studies based on:
- An issue relating to the application of a new directive in the company;
- A particularly conflictual situation involving the dismissal of a protected representative.
