Dismissals in 2026: the new rules explained to employers

The government has made significant changes to the rules governing the termination of employment contracts. These rules were introduced by the Act of 18 May containing various provisions relating to labour law and the Act of 3 June 2026 amending Article 37/2 of the Act on employment contracts. The first Act came into force on 1 June, whilst the second will come into force on 1 August 2026.

Between the introduction of a maximum notice period of 52 weeks and the reduction in notice periods during the first six months of employment, employers must review their recruitment and dismissal practices.

 

PROGRAMME

During this practical seminar, we will address the following questions in particular:​

  • Can I now dismiss a new employee with just one week’s notice?
  • Have the first six months become a new probationary period?
  • Do the new rules apply to all employees or only to new contracts?
  • What happens if an employee was hired before the reform came into force?
  • What are the new rules regarding counter-notice?
  • Have the rules regarding the grounds for dismissal also changed?
  • What are the legal risks despite the reduction in notice periods?


We will also examine the reform of the maximum notice period in detail:

  • Is the notice period now actually capped at 52 weeks?
  • Which employees are affected by this cap?
  • How should the notice period be calculated when an employee’s career spans several decades?
  • Does this reform actually reduce the cost of redundancies?
  • Should recruitment policies or employment contracts be adapted?

 

Finally, we will address the practical implications of these reforms for employers:

  • How can the first six months of employment be managed effectively?
  • Should onboarding and appraisal procedures be reviewed?
  • What new HR practices should be adopted?
  • What pitfalls should be avoided when making a dismissal in 2026?

 

The seminar will be illustrated with numerous practical examples and real-life cases drawn from business practice.​
